Bonimo General Terms and Conditions

1 - Object and Validity

(hereinafter referred to as “Monet”) operates a shopping platform on https://www.bonimo.com and other websites, as well as mobile applications (a.k.a. Apps), on which users can buy products, in particular digital products and vouchers (hereinafter referred as “Bonimo”). To shop at Bonimo, a paid membership (“Bonimo membership”) is required.

1.2 The use of Bonimo shall be subject to the following General Terms and Conditions (“General Terms and Conditions”) in the version valid at the time of your registration or order.

1.3 No separate contract text is provided for the agreement pertaining to the use of Bonimo. The content of the agreement between you and Monet is based on these General Terms and Conditions, as well as on the specific information provided to you as part of the registration (see Section 3), when ordering a paid subscription (Section 4) and/or products(see Section 6).

1.4 You accept the validity and applicability of these General Terms and Conditions when registering, purchasing a paid subscription or products, as the case may be.

2 - Monet’s Services and Rights

2.1 Bonimo is a shopping platform, in particular for digital products and vouchers. Bonimo offers different payment methods, among others the capability to receive products immediately and pay for them later (“buy now, pay later”). To shop at Bonimo a paid membership (“Bonimo Membership”) is required.

2.2 Monet reserves the right to offer some payment methods only after a positive credit check.

3 - Registration

3.1 In order to use Bonimo's services, registration is required. People aged 18 and over are eligible to register.

3.2 Registration itself is free (free account) and does not require you to take out a paid subscription. By registering, you conclude a contract with Monet for limited, free use of the platform.

3.3 Monet is entitled to store and process the data provided during registration in accordance with data protection regulations.

4 - Executing an Agreement for a Paid Subscription

4.1 To be able to fully benefit from Bonimo’s services, additional service packages in the form of paid subscriptions (“Bonimo membership”) are available to you after registering. These can be purchased for different, and variable periods of time, which you will see in the order options.

4.2 Bonimo's membership accounts are paid subscriptions that enable you to purchase products with different payment methods via our mobile and web-based applications.

4.4 You will have access to the respective services as long as your subscription is valid.

5 - Trials / Testing Phases

5.1 Monet occasionally offers in particular to new users free Bonimo memberships for testing purposes for a certain period of time (“Trial”). Monet determines, at its sole discretion, if you may participate in a Trial. In case of an important reason, Monet may discontinue or change such free Trial at any time without prior notice or notification.

5.2 You can only participate in certain Trials if you enter your payment details when you sign up for the Trial. In such a case, we need your consent at the beginning of the Trial that your free access will be converted into a paid Subscription Access (Section 4) on the day following the end of the Trial. In this situation, your subscription renews itself on a recurring basis and can be terminated up to one day before the end of the respective subscription period.

5.3 If, in a case of Section 5.2 , you do not wish to have the Subscription Access and the charge associated with it, you must cancel your membership given to you during the Trial before the end of the Trial.

6 - Ordering products

6.1 With a paid Bonimo membership you get access to the Bonimo member area, where you can purchase products, in particular digital products and vouchers.

6.2 There are various payment methods for paying for products in the Bonimo member area, which you can qualify for after subscribing to a Bonimo membership.

7 - Withdrawal Policy

7.1 The following applies to Bonimo membership: If you are a consumer (i.e., a person completing the legal transaction for purposes that can be predominantly attributed to neither their commercial nor their independent professional activity), you are entitled to a statutory withdrawal right when concluding a distance selling agreement.

7.3 The following applies to the purchase of products: The purchase is for the delivery of digital content that is not delivered on a tangible medium. By their nature, these digital products may be excluded from the right of withdrawal. Monet excludes that right of withdrawal. Before any purchase can be made, the consumer must expressly agree to allow Monet to begin delivery and the consumer must declare that they thereby waive their right of withdrawal.

8 - How the “Buy now, pay later” payment method works

8.1 In the membership area you will be able to activate the “Buy now, pay later” functionality.

8.2 To use buy now, pay later you have to connect a bank account via an open banking interface (“Linked Bank Account”). The digital account statement is stored and retrieved by certified service providers.

8.3 To use buy now, pay later you agree to a periodical credit check. This credit check is carried out using a digital bank statement from the linked account.

8.4 Additionally, to use buy now, pay later, we will ask you to link a debit card. We reserve the right to only accept certain debit cards and might ask you to link a different debit card to access buy now, pay later.

8.5 When choosing the buy now, pay later payment method for an order you authorize us to debit the purchase amount at a later time from your linked debit card. We will check the account balance of your linked bank account periodically and will debit the purchase amount, once the available amount on your linked bank account exceeds the purchase amount, but at the earliest 3 days after your purchase.

8.6 Should the connection to your linked bank account be lost, we will ask you to reestablish the connection. If the connection is lost for longer than 3 days, we will attempt to debit partial amounts until the purchase amount is paid.

9 - Term and Cancellation

9.1 Duration of the free user contract: The free user contract runs for an indefinite period from the time of your registration in accordance with Section 3 of these terms of use. You can cancel the free user agreement at any time.

9.2 The paid subscription for the membership (see number 4) runs at least for the term you originally selected and is automatically extended for an indefinite period of time if it is not canceled at least 24 hours before the end of this period. If you did not cancel your original paid subscription or did not cancel it in a timely manner, you can cancel the extended subscription at any time with one month's notice.

9.4 Cancellation of subscription access will take effect on the day after the last day of your current subscription period and you will be downgraded to the free usage contract (free account).

9.4 The right to suspende and terminate for good cause remains unaffected by the previous provisions.

10 - Applicable Law

10.1 These conditions are governed by the laws of Germany, and the application of the United Nations Convention of Contracts for the International Sale of Goods is expressly excluded. If you are a consumer and have your habitual residence outside of Germany, you additionally enjoy the protection afforded to you by mandatory provisions of the law of your country of residence.

11 - Final Provisions

11.1 If any provision of these General Terms and Conditions is invalid, the remainder of the agreement remains valid. The statutory provisions shall take effect over the invalid regulations.
